This update concerns the Kerber v. Qwest case (Pension Death Benefits case).
We received permission from the Denver Federal Court judge to go forward with the Second Amended Complaint which now has 5 plaintiffs. As reported in my November 1 update, we have expanded the case with the intent to protect the rights of hundreds of recent retirees, persons who ended employment at Qwest since January 1, 2004 and have been told they will not receive the Pension Death Benefit. By order dated November 29, Qwest's defense counsel were given an extension of time until December 22 within which to respond to the Second Amended Complaint.
